Litigation is a diverse process and requires one to be knowledgeable. For a person to qualify to be a litigator, he or she requires to;

i. Obtain a bachelor’s degree: there is no official degree program required for admission in a law school, but a person aspiring to become a litigator may first take a bachelor’s degree of his or her choice. Most common majors include English, history, government, and economics. These courses may help a person cope with the challenging demands of law school. Also, a student needs to be good in history, world news, finance, cultural diversity, and society.

ii. Earn a Juris Doctor Degree: law degree program typically takes three years to complete. In the first year, students are taught general legal topics such as civil procedure, legal writing, torts, and ethics. The other two years, students focus on their area of specialization such as litigation.

iii. Pass bar exam: a license is required for a person to participate law in any state in the US. For a qualified graduate to be licensed, he or she must sit in for a bar exam. Each state has its own bar exam which is administered by the licensing agency. The bar exam covers both the state law and general legal topics.

In addition, the following key skills are essential in litigation practice. These include; negotiation skills, excellent interpersonal skills, the ability to handle complex legal and factual materials, strong oral and written communication, knowledge of legal research techniques and software, the ability to think logically, and analytical skills.

Civil litigation is broad process that can be divided into several phases such; investigation, pleading, discovery, pre-trial, trial, and appeal. Discovery is the most critical stage. It involves the exchange of information concerning the case through interrogations, statements, and summons.

It is not every lawsuit that goes through all the stages. Some cases are settled by agreements between the complainant and the defendant with the help of litigator before reaching the courtroom.
